No gay marriage in TENNESSEE!! The U.S. Court of Appeals for the Sixth Circuit has upheld marriage bans in several states under its jurisdiction, breaking with the momentum of most other appeals courts and sending the issue on a sure course to reach the U.S. Supreme Court. The Court declined to hear a case testing the constitutionality of traditional marriage laws last month, partly (in the view of many observers) because the circuits had not yet split openly on the issue. Bush appointees upholding the state laws, and a Bill Clinton appointee dissenting. The majority ruled that as same-sex marriage becomes legal, it should be made so by the people, not the courts: "Even if we grant the premise and assume that same-sex marriage will be recognized one day in all fifty States, that does not tell us how--whether through the courts or through democracy."
